By means of the Website, Silver Lake gives Users access to different services and Contents (hereinafter referred to as “Services”) made available by Silver Lake or by third parties.

3.3. Information Veracity
In consideration of use of Services subject to User registration, in registering and providing such data, Users represent and warrant that the information is true, accurate, current, and complete and that they will maintain and promptly update the data provided to Silver Lake to keep it true, accurate, current and complete. Besides, the User will be the one and only responsible regarding any damage caused to Silver Lake or any other party due to untrue, inaccurate, not current or incomplete information provided.

3.4. Minors
In order to use the Services that require the collection of Personal Data by Silver Lake, minors under thirteen years of age (hereinafter referred to as “Minors”) should obtain permission from their parents, tutors or legal representatives, who will be considered responsible for all acts made by the minor in their care.

The full responsibility in the determination of the specific contents and services accessed by minors corresponds to the adults in charge of them. (d) incorporates, makes available or allows access to products, elements, messages and/or criminal, violent, offensive, harmful, degrading services or, in general, those against the law, the morale and generally accepted good practices or public interest;

(f) induces or incites one to participate in dangerous, risky or harmful practices against public health and the psychological balance;

(h) is protected by any intellectual or industrial property rights pertaining to third parties, without the User having previously obtained the authorization necessary for the use or intended use;

(i) violates the business secrets of third parties;

(j) could be against the right to honor, to personal and family privacy or the image of the person;

(k) in any way diminishes the credit of Silver Lake or third parties;

(l) infringes the standard on the secret of communications;

(m) constitutes, in its case, unlawful, misleading or illegal advertising and, in general, those that constitute illegal competition;

(n) incorporates viruses or other physical or electronic elements that could harm or impede the normal operation of the network, the system or computer equipment (hardware and software) of Silver Lake or of third parties or that could harm the electronic documents and files stored in said computer equipment;

(o) provokes for its characteristics (such as format, extension, etc.) difficulties in the normal operation of the service;

(p) contains HTML tags different from those expressly authorized by Silver Lake.
3.6. Obligation for correct use of the contents

In compliance with that included in clause 3.5, the User commits to using the contents made available to in the Website, understanding these, without this enumeration having a limited character, as texts, photographs, graphics, images, icons, technology software, links and other audiovisual or sound contents, as well as graphic design and source code (hereinafter, the “Contents”), in compliance with the law, the present legal warning, the specific conditions of certain services and other warnings, rules of use and instructions brought to their attention, as well as with the morale and generally accepted good practices and public interest, and, in particular, commits to abstain from:

(a) reproducing, copying, distributing, making available or in any way communicating publicly, transforming or modifying the Contents, unless with the authorization of the owner of the corresponding rights or it being legally permitted;

(b) removing, manipulating or in any way altering the “copyright” and other identifying data of the reservation of rights of Silver Lake or of its owners, the digital prints or any other technical means established for recognition.

3.7. Use of the services offered in the Website in compliance with the Anti-Spamming policy of Silver Lake

The user is obligated to abstain from:

(i) compiling data for advertising purposes and issuing advertising of any class and communications for sales purposes or other commercial intentions without prior request or consent;

(ii) issuing any other unsolicited or not previously consented messages to a plurality of people;

(iii) sending chains of unsolicited and not previously consented email messages;

(iv) using distribution lists that can be accessed through the Services for the implementation of the activities marked in the previous sections (i) to (iii);

(v) making available to third parties, with any purpose, data compiled from distribution lists.

The users and, in general, those people that want to establish a link between their website and the Website (hereinafter, the “Link“) should fulfill the following conditions:

Silver Lake will also block access and/or terminate subscribers and or account holders who are repetitive offenders. Infringement-related communications must be sent to:

We may also share notices of alleged infringement with the affected party. Silver Lake will provide the affected party an opportunity for injunctive relief pursuant to the Digital Millennium Copyright Act (“DMCA”) before Silver Lake removes or disables access to material as a result of the communication.

9. Removal and suspension of the service

Silver Lake can remove or suspend, at any time and without prior warning, the services to those users that do not comply with that established in the present Legal Notification.

10. Length and resolution

The services of Website and other Services have, in general, a limited length.

Silver Lake, however, is authorized to terminate or suspend services of the portal and/or any of the services at any time, notwithstanding that which could be included in the corresponding Specific Conditions. When it is reasonably possible, Silver Lake will previously advise of the termination or suspension of the service of Website and other Services.

11. Applicable legislation

The present Legal Notice is ruled by the laws of the State of Georgia and the United States of America.

12. Governing Law

Silver Lake and the User will abide solely by the decisions of the Courts of Law of the State of Georgia in the United States of America.
